CBA National hosted its virtual annual general meeting on February 9th, 2023, with all members invited to join and help shape their association, by debating and voting on the resolutions that matter to them.
The resolutions that were available for voting were:
- CBA Bylaw Amendments
- United Nations Convention on the Rights of the Child
- National Plan for Intersectional Judicial Demographic Data Analysis and Reporting
- Promoting Language Rights and the Role of French in the CBA
- Principles to Prevent Misuse of Non-Disclosure Agreements in Cases of Abuse and Harassment
All resolutions were adopted by an overwhelming majority, especially the Principles to Prevent Misuse of Non-Disclosure Agreements in Cases of Abuse and Harassment. Detailed background information on this resolution can be found here.

A similar topic has also recently been discussed in Nova Scotia. Bill 144 the Non-disclosure Agreements Act had its first reading in April 2022.
Coverage of Bill 144 has been widespread throughout the province with a segment live on CBC radio the day following CBA’s vote, and through campaigns such as Can’t Buy My Silence, the purpose of which is to support legislative and regulatory change to make NDAs unenforceable for anything other than to prevent the sharing of intellectual property, trade secrets, and confidential business information.
Bill 144 is expected to be brought back before the house in Nova Scotia in the Spring of 2023.
What are NDAs?
NDA stands for Non-Disclosure Agreement, which is a contract created by one or more parties who agree to protect [not disclose] confidential information that has been previously shared with one another. The original purpose of these contracts was to protect confidential business information and trade secrets.
